PAINE V CARTER HOLT HARVEY & ORS

This is an interlocutory skirmish between the homeowners and CHH.  The judgment addresses CHH’s applications: (1) to strike out the homeowners’ claim for abuse of process; (2) for leave to appeal a judgment on further and better particulars to the Court of Appeal; and (3) for a stay pending appeal.

The court declined to make the orders sought by CHH.
