ADAMS V GREATER WELLINGTON REGIONAL COUNCIL (HC)

Frana Divich successfully defended the Greater Wellington Regional Council (the Council) from an application by a third party that a preliminary question be determined in advance of the trial.

The Court found that it was not a case where the high threshold for having a preliminary question determined was reached and the application was declined.

The Council was awarded costs.
